Terms of service.
The rules for using mailvitals.com: what we provide here, what we ask of you, and what each side is responsible for.
Who we are, and what these terms cover
mailvitals.com is run by Frank (MailVitals’ founder), trading as MailVitals (details in the legal notice). These terms apply to this website: the free tools and scan, the Academy courses, the blacklist wiki, the blog, booking a demo, the consulting request form and the early-access lists. By using the site you accept them.
Our products, Beat, Pulse and Reps, are provided under the agreement you sign when you buy them. Consulting work is governed by the written proposal you accept. Where one of those says something different from this page, it wins.
For businesses
Our services are offered to businesses and professionals. By using a form or creating an account you confirm you are acting for a business or in your profession, not as a consumer.
The free tools and scan
- They are free, provided as they are, and may change or stop at any time. Results describe what public DNS and the blacklists answered at the time of the lookup; they are information, not a guarantee of where your mail will land.
- They are rate limited. Do not try to get round the limits, overload the tools, or use them to attack, map or harass anyone else’s infrastructure.
- Only check domains and addresses you are entitled to look into.
Academy accounts
An account only remembers your course progress. Keep access to your email address secure: anyone who can read it can sign in. You can ask us to delete your account at any time. We may close an account that is used to abuse the site.
Demos and early access
Demos are free and commit you to nothing. Every request is confirmed by us; one request or demo per person at a time, and a request we cannot confirm in time expires. Joining an early-access list commits neither side: dates we give for products that are not open yet are plans, not promises.
Consulting
Sending the consulting form asks for a proposal; it is not an order. Work starts only once you accept a written proposal, at $65 an hour unless the proposal says otherwise, and is never billed beyond the cap it sets without your agreement.
Using the content
The courses, wiki, blog, tools and design of this site belong to us. You may read them, link to them, and quote short passages with a link back. Do not copy or republish them in bulk, or present them as your own. What a tool tells you about your own domain is yours to use however you like.
What we ask of you
- Use the site lawfully, and give true information in our forms.
- Do not use anything here to support unsolicited bulk email.
- Do not probe, scan or disrupt the site itself, or try to reach anything that is not offered to you.
Responsibility
Deliverability advice describes good practice; the decision to deliver an email always belongs to the receiving provider, so no one can guarantee inbox placement. As far as the law allows, we are not liable for indirect loss (lost revenue, lost data, lost opportunities) arising from the free parts of this site. Nothing here limits liability that the law does not allow to be limited, such as for fraud or gross negligence.
Links to other sites
We link to other sites when they help, for example blacklist operators. We are not responsible for their content.
Changes
We may update these terms; the date at the top shows when. Changes apply from that date and never reach back to something you already agreed in a proposal or contract.
Law and courts
These terms are governed by French law. Any dispute that cannot be settled between us goes to the competent courts in France.
Contact
A heartbeat for your email.
Beat runs every check on this site on a schedule: 41 checks, 50 blacklists and real inbox placement. The moment something breaks, it tells you what broke, why it matters, and the exact fix.
